This bill would establish a voluntary deductible program.  Employers participating in a deductible program would directly reimburse the Department for claims costs up to a specific dollar amount per claim.  In return, the employer would be given a reduced industry base rate, with the amount of the reduced base rate being determined by the size of the deductible.  The number of employers who might decide to participate in a deductible program is indeterminable as is the amount of the deductible that would be chosen.  Consequently, the fiscal impact of this bill to the Industrial Accident Fund is indeterminable.  The North Dakota Workers’ Compensation Department does have a deductible program.  That department indicates that the reduced revenue is offset by reduced claims costs resulting in negligible impact on their fund. 

 

This bill has administrative impact that appears to increase (or decrease) duties or responsibilities of one or more state agencies and may impact agency spending or staffing requirements.  As introduced, the bill does not modify any state agency budget or current personnel authorizations.  The following state agencies may be affected administratively:
