AN ACT relating to railroads; authorizing the appointment of railroad peace officers and specifying their qualifications and authority; specifying responsibility for liability arising from the acts or omissions of railroad peace officers; limiting definitions; and providing for an effective date.

Each operating train in this state shall have a conductor. The conductor in charge of any car or train who finds any person on his car or train, violating the provisions of this act [§§ 37-12-104 through 37-12-107], is hereby made a special constable, authorized to arrest any such person and deliver him free of all transportation expense to the first sheriff, or deputy sheriff or rail police officer that may be available in the progress of such car or train. Such special constable shall deliver to the sheriff, or deputy sheriff or rail police officer with his prisoner a statement in writing showing in a brief and general but not technical way, the offense charged against the prisoner.".  MOCKLER
