(a) The department of health
shall:
(vi) Receive and disburse
funds authorized by P.L. 89‑73, the "Older Americans Act", or
funds appropriated by the legislature, or from private gifts or grants,
after consultation and coordination with the council on aging;

(a) The department
advisory council on aging appointed pursuant to the "Older Americans
Act", P.L. 89-73, is established as the state advisory council to
a designated division on aging. Each member serving on the council as of
April 1, 1991 shall continue to serve until the normal expiration of his term
and any member is eligible for reappointment. Each member serving on the
council as of July 1, 2003 shall continue to serve until the normal expiration
of his term and may be reappointed as provided in subsection (b) of this
section.
(b) Effective July 1,
2003, the council shall consist of ten (10) twenty-three (23)
members, one (1) from each county, appointed by the director governor
for terms of four (4) years. There shall be one (1) member of the
advisory council from each appointment district and one (1) member each
representing the pioneer home, the veteran's home and the Wyoming retirement
center. All appointments shall be for a
four (4) two (2) year term. The
governor shall select each county's appointee from names submitted by the
members and project directors of the Wyoming senior citizens centers of that
county. Members and project
directors of the Wyoming senior citizens' centers in each county shall develop
processes for submitting names to the governor for appointment to the
council. The terms of members appointed
after July 1, 2003 shall be staggered in a manner to ensure continuing experience
on the council. The director
governor may remove any member as provided in W.S. 9-1-202.
9-2-1207. State
council on aging; officers; meetings; quorum; records; expenses; powers and
duties; grants.
(a) The council shall elect
each year from its members a chairman, vice-chairman and secretary in
accordance with Robert's rules of order. The chairman shall appoint
committees and chairmen of the committees as necessary, set meetings including
the time and location of meetings, establish the agendas for meetings and
conduct the meetings in accordance with Robert's rules of order. The council shall also elect each year from
its members four (4) additional members which together with the officers of the
council shall constitute the executive board of the council.
(c) Six (6) A
majority of the members of the council shall constitute a quorum for
the transaction of council business. For any committee appointed pursuant to
subsection (a) of this section, a majority of the membership of the committee
shall constitute a quorum for the transaction of committee business.
(f) Members of the council
shall:
(i) Advocate for senior
citizens in the state;
(ii) Perform council or
committee duties as directed by the chairman;
(iii) Attend meetings
regularly; and
(iv) Assume responsibility
for promoting the purposes of the council in their individual communities and
associations.
(g) The council shall:
(i) Advise the governor and
state agencies on the use of available and potential resources to meet the
needs of senior citizens in the state;
(ii) In consultation with the
division on aging and the Wyoming senior citizens' project directors'
association:
(A) Undertake a wide range of
advocacy, capacity building and systemic change activities directed at
improving access to community services and supports for senior citizens;
(B) Provide for a mutual
exchange of ideas and information on national, state and local levels.
(iii) Make recommendations to
the division on aging and the Wyoming senior citizens' project directors'
association for needed improvements and additional resources to promote the
welfare of senior citizens;
(iv) Review and comment on
all state plans that relate to programs affecting senior citizens. The comments
shall be submitted to the governor, the division on aging and the Wyoming
senior citizens' project directors' association;
(v) Serve as an advisory and
advocacy body in regard to proposed legislation affecting senior citizens;
(vi) Submit names to the
director of the department of health for his consideration in the appointment
of an administrator for the division on aging;
(vii) Provide recommendations
to the division on aging on the preparation of a plan for the use of federal
and state funds, including grants and legislative appropriations;
(viii) Monitor, review and
evaluate the implementation of federal and state funds, including grants and
legislative appropriations and make recommendations to the division on aging
for the proposed use of those funds.
The evaluation shall be sent to the governor, division on aging and Wyoming
senior citizens' project directors' association.".
