AN ACT
relating to school finance; establishing a cost-based adjustment to the education
resource block grant model for vocational education; providing for grants to
districts to assist with initiating vocational education programs; defining
terms; imposing funding conditions and criteria; delegating rulemaking
authority to and imposing specified duties upon the state department of
education and the school audit section of the department of audit; imposing
reporting requirements upon school districts; providing appropriations and
authorizing positions; and providing for effective dates.

5.
(a) Effective
school year 2003-2004, the state superintendent shall provide grants to school
districts from the school foundation program account to fund district
vocational education programs in grade eight (8) until such time as statewide
vocational education program guidelines are developed for vocational education
programs in grade eight (8), and a separate vocational education funding
mechanism within the education resource block grant model is established
pursuant to subsection (f) of this section.
Amounts awarded under this section shall be used to fund vocational
education programs that are aligned to the statewide content and performance
standards prescribed by the state board of education under W.S. 21‑2‑304(a)(iii),
are provided by a teacher certified by the Wyoming professional teaching
standards board for the vocational subject area associated with the course and
are related to or integrate with career-vocational education programs in grades
nine (9) through twelve (12) as defined under W.S. 21‑13‑329(a)(i),
as created under section 1 of this act.
(b) Any
district may on or before June 30, 2003, apply to the state superintendent for
a grant under subsection (a) of this section.
Application shall be on a form and in a manner specified by rule and
regulation of the state superintendent and shall at minimum specify the planned
expenditure of requested funding.
Following review of district applications and not later than August 15,
2003, the state superintendent shall notify districts if a grant will be
awarded under subsection (a) of this section, and if so, shall issue the grant
to the district.
(c) Each
recipient district shall report to the state superintendent on the expenditure
of grants awarded under subsection (a) of this section and shall provide other
information as may be required by the state superintendent to carry out the
grant program established under this section.
(d) The
state superintendent shall develop necessary rules and regulations to implement
the grant program established under this section and shall as soon as
reasonably possible, notify districts of the availability and purposes of
vocational education program grants authorized under this section.
(e) Any
amount awarded under this section shall be in addition to and not be considered
in determining the vocational education adjustment prescribed under W.S. 21‑13‑329,
as created under section 1 of this act.
(f) The
state department of education shall, in consultation with the state board of
education, develop minimum program criteria and guidelines prescribing the
focus of vocational education programs at the middle and junior high school
level. This effort shall be conducted
in consultation with school district expertise and shall be directed to provide
recommendations for program delivery and structure and shall prescribe criteria
and mechanisms for the most cost-effective use of resources in the provision of
vocational education programs at these grade levels. On or before November 1, 2003, the state department shall report
recommendations and findings under this subsection to the joint education
interim committee. Based upon
information and recommendations under this subsection, the joint education
interim committee shall conduct a study to establish an adjustment to the
education resource block grant model for vocational education programs at the
middle and junior high school grades.
Committee recommendations, including necessary enabling legislation,
shall be reported to the 2004 budget session of the legislature.".

or before November 1, 2003, results of this effort shall be summarized and
reported to the joint education interim committee and the joint appropriations
interim committee.
(d) Boards
of cooperative educational services shall assist the community college
commission with data collection efforts required under subsection (a) of this
section.".
